Welcome to Raven's Dance Sailing. By accessing or using our website ravensdancesailalaska.com (the "Site") or booking our sailing charter services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing the Site or using our services, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree to these Terms, please do not use our Site or services.

2. Services Description

Raven's Dance Sailing offers private sailing charter experiences in Southeast Alaska aboard our 1985 Nauticat 43 motorsailer, "Raven's Dance." Our services include multi-day sailing voyages, wildlife viewing, kayaking, fishing, and related activities.

3. Booking and Payment Terms

3.1 Reservations

All reservations are subject to availability and confirmation. A booking is not confirmed until we have received your deposit and sent written confirmation.

3.2 Deposit and Payment

• A 50% deposit is required to confirm your booking
• The remaining balance is due 60 days prior to departure
• Payments made less than 60 days before departure require full payment at booking
• We accept major credit cards, checks, and bank transfers

3.3 Pricing

All prices are quoted in US dollars and are subject to change without notice. Once your booking is confirmed with a deposit, the quoted price is guaranteed for that trip.

4. Cancellation Policy

• 90+ days before departure: Full refund minus $500 administrative fee
• 60-89 days before departure: 50% refund of total trip cost
• Less than 60 days before departure: No refund

If we can rebook your dates with another party, we will work with you on a credit toward a future trip. We strongly recommend purchasing comprehensive travel insurance.

4.1 Cancellation by Raven's Dance Sailing

In the rare event that we must cancel a trip due to vessel mechanical issues, crew emergency, or other circumstances within our control, you will receive a full refund or the option to reschedule at no additional cost. We are not responsible for your travel expenses or other costs incurred.

4.2 Weather and Safety

The Captain has final authority over all safety-related decisions, including itinerary modifications due to weather or sea conditions. Such modifications are not considered cancellations and do not entitle guests to refunds.

5. Guest Responsibilities

5.1 Health and Fitness

Guests should be in reasonably good health and able to board the vessel, navigate stairs and ladders, and move around a boat in motion. Please inform us of any medical conditions, mobility limitations, or dietary restrictions before departure.

5.2 Safety Compliance

All guests must follow the Captain's instructions regarding safety procedures, equipment use, and vessel operations. Failure to comply may result in termination of the charter without refund.

5.3 Prohibited Conduct

The following are prohibited aboard Raven's Dance:

• Illegal drugs or substances
• Excessive alcohol consumption that impairs safety
• Harassment of crew or other guests
• Reckless behavior that endangers persons or property
• Smoking inside the vessel (designated outdoor areas only)

6. Assumption of Risk

Sailing and outdoor activities in Alaska involve inherent risks, including but not limited to: rough seas, inclement weather, wildlife encounters, physical exertion, and remote locations with limited access to medical care. By participating in our charters, you acknowledge and voluntarily assume these risks.

7. Liability Waiver

To the fullest extent permitted by law, Raven's Dance Sailing, its owners, operators, and crew shall not be liable for any injury, illness, death, property damage, or loss arising from participation in our charters, except in cases of gross negligence or willful misconduct.

Guests will be required to sign a liability waiver and release form prior to boarding.

8. Travel Insurance

We strongly recommend that all guests purchase comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and baggage loss. Alaska's remote wilderness requires preparation for unexpected situations.

9. Intellectual Property

All content on this Site, including text, images, logos, and design elements, is the property of Raven's Dance Sailing and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

10. Photography and Media

We may take photographs and videos during your charter for promotional purposes. By booking with us, you consent to the use of your likeness in our marketing materials. If you prefer not to be photographed, please inform us before departure.

11. Website Use

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable laws
• Attempt to gain unauthorized access to any part of the Site
• Transmit malware or other harmful code
• Interfere with the Site's operation

12. Disclaimer of Warranties

The Site is provided "as is" without warranties of any kind. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, Raven's Dance Sailing shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or services.

14. Indemnification

You agree to indemnify and hold harmless Raven's Dance Sailing, its owners, operators, and crew from any claims, damages, or expenses arising from your violation of these Terms or your use of our services.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alaska, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Alaska.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
